1. Acceptance of Terms

By creating an account or using JOY JOY, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. Description of Service

JOY JOY is a platform that connects travelers with local guides offering trips, activities, and experiences. We facilitate bookings between customers and guides but are not ourselves a travel agency or tour operator.

3. User Accounts

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these terms.

4. Bookings and Payments

For Customers:

• When you book a trip, you enter into an agreement with the guide, not with JOY JOY.
• Prices are set by guides and displayed in the app. All fees are shown before you confirm a booking.
• Payment is processed securely through our payment providers.
• Cancellation policies are set by individual guides and displayed on each trip listing.

For Guides:

• You are responsible for the accuracy of your listings.
• You must honor confirmed bookings unless cancellation is unavoidable.
• JOY JOY charges a service fee on each booking, as specified in your guide agreement.

5. Cancellations and Refunds

Cancellation policies vary by trip and are set by guides. Please review the cancellation policy before booking. Refunds are processed according to the applicable cancellation policy:

• Free cancellation period: Full refund minus payment processing fees
• After deadline: Refund according to the guide's policy
• No-show: No refund unless otherwise stated

If a guide cancels a trip, you will receive a full refund.

6. User Conduct

You agree not to:

• Use the service for any illegal purpose
• Harass, abuse, or harm other users or guides
• Post false, misleading, or fraudulent content
• Attempt to circumvent our platform for direct bookings
• Interfere with the proper functioning of the service
• Copy, modify, or distribute our content without permission

7. Content and Reviews

Users may post reviews and content. By posting, you grant us a non-exclusive, worldwide license to use, display, and distribute such content. You are responsible for ensuring your content does not violate any laws or third-party rights.

We reserve the right to remove content that violates these terms.

8. Limitation of Liability

JOY JOY is a platform connecting customers and guides. We are not responsible for:

• The quality, safety, or legality of trips offered by guides
• The accuracy of guide listings or descriptions
• Disputes between customers and guides
• Personal injury, property damage, or other harm during trips

To the maximum extent permitted by law, JOY JOY shall not be liable for any indirect, incidental, special, or consequential damages.

9. Indemnification

You agree to indemnify and hold harmless JOY JOY and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these terms.

10. Intellectual Property

The JOY JOY name, logo, and all related content are our intellectual property. You may not use our trademarks without prior written consent.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of our service at any time. We will provide notice of significant changes when possible.

12. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify users of material changes.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of France. Any disputes shall be resolved in the courts of France.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in effect.
